Clarification on Work Visa Applications for Foreigners

The Government has clarified that Kenya’s visa-free entry regime does not automatically allow foreign nationals to work, trade or operate businesses in the country.
While Kenya remains open and welcoming to visitors and legitimate investors, all foreigners engaging in employment or business must comply with the relevant immigration, work permit and regulatory requirements.
In a statement, Investments, Trade and Industry Cabinet Secretary Lee Kinyanjui said the clarification follows cases where some visitors have misused tourist or investor status to engage in activities outside the terms of their visas, particularly in the retail and local trade sectors.
“Visa-free entry or exemption from eTA requirements does not in itself confer the right to engage in employment, trade or business in Kenya. Such activities remain subject to the applicable immigration, work permit and other regulatory requirements,” said CS Kinyanjui.
The Government will enforce the directive in an orderly and transparent manner and in accordance with the law. Those found violating visa provisions will have their visas revoked.
In implementing the directive, Kenya will continue to uphold its commitments under the East African Community, including the free movement of people and goods. The Government remains committed to supporting legitimate investors and businesses that contribute to economic growth, job creation and national development.
